29 CFR 1910.134(c)(1): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use. On or about April 19, 2021, and at times prior thereto, employees were required to wear a respirator during tasks including but not limited to the cutting, grinding, and polishing of granite material, exposing the employees to hazards associated with the use of a respirator. The employer did not implement a written respiratory protection program. Such program shall include but not be limited to the following: a) Ensuring employees are medically cleared to wear a respirator. b) Ensuring respirators are stored to protect against contamination. c) Prohibiting facial hair to ensure a good respirator to face seal. d) Training on proper use and care of respirators.

Instance 1: On or about April 19, 2021, and at times prior thereto, the employer did not ensure employees had received a medical examination in relation to respirable crystalline silica within 30 days of initial work assignment of cutting, grinding, and polishing granite counter tops, exposing employees to the hazard of inhaling silica dust. Instance 2: On or about April 19, 2021, and at times prior thereto, the employer did not make initial medical examinations available for employees performing granite counter top cutting, grinding, and polishing processes, exposing employees to the hazard of inhaling silica dust.
