29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval. On or about April 19, 2021, and at times prior thereto, employees operating a UNICARRIER, Nomad 50 forklift, used an attachment not authorized by the manufacturer to moved large pieces of stone, exposing employees to pinch point, struck-by, and caught between hazards.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about April 19, 2021 and at times prior thereto, employees were operating a UNICARRIER, Nomad 50 forklift, without the employer confirming training and competency of the operators, exposing employees to struck-by hazards.
