OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to stuck-by and/or crushed-by hazards:  (a) On or about 4/20/2021- Fabrication Department, an employee was observed operating a forklift without wearing the seat belt. Employees use the forklift daily to transport stone slabs from the delivery area in the parking lot. The employer was not enforcing that  seat belts be worn by forklift operators exposing employees to struck-by and crushed-by hazards.  (b) On or about 5/06/2021- Fabrication Department, an employee was observed operating a forklift without wearing the seatbelt. Employees use the forklift daily to transport stone slabs from the delivery area in the parking lot.  The employer was not enforcing that seat belts be worn by forklift operators exposing employees to struck-by and crushed-by hazards.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical:  (a) On or about 05/06/2021- Fabrication Department, the employer did not ensure that secondary containers of chemicals such as, but not limited to, Akemi Stain Repellant were properly labelled.  Rio Stone Group, LLC was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.1200(f)(6)(ii), which was contained in OSHA inspection number 1479032, citation number 1, item number 4(b) and was affirmed as a final order on 01/13/2021, with respect to a workplace located at 245 Scotland Drive, Alabaster, AL 35007.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:  (a) On or about 05/06/2021- Fabrication Department, employees wearing tight-fitting facepiece respirators had facial hair that came between the sealing surface of the facepiece and the face.
