29 CFR  1910.134(e)(7)(iv): The employer did not provide additional medical evaluations that complied with the requirements of 29 CFR 1910.134 when a change occurred in the workplace conditions that resulted in a substantial increase in the physiological burden placed on an employee:  World Trade Center jobsite: On or about, April 23, 2021, employees required to wear respirators were not provided with an additional medical evaluation to determine the employee's ability to use a respirator with a change workplace conditions (e.g., physical work effort, protective clothing, respiratory protection, chemical exposure, and temperature) that may result in a substantial increase in the physiological burden placed on an employee.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:    World Trade Center jobsite: On or about, April 23, 2021, employees that had significant facial hair that came between the sealing surface of the facepiece and their face,  thus not ensuring an adequate face to facepiece seal, were required to use tight-fitting facepiece respirators .
