29 CFR  1910.134(a)(2): Respirators were not provided by the employer when such equipment was necessary to protect the health of the employee(s):  At Westborough Behavioral Health Hospital located at 300 Friberg Parkway Westborough, MA 01581  On or about January 07, 2021, employees engaging in direct and one-to-one care of adult and adolescent patients, were provided only with surgical mask or KN95 devices for protection against aerosolized SARS-CoV-2 virus and were not provided with appropriate respirators. At a minimum, a N95 NIOSH-certified filtering facepiece respirator is necessary to protect employees from aerosolized SARS-CoV-2 virus.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, the identity of the workplace evaluated, the person certifying that the evaluation had been performed, and the date the hazard assessment was done:  At Westborough Behavioral Healthcare Hospital located at 300 Friberg Parkway Westborough, MA 01581:  On or about January 07, 2021,  the employer had not verified through a written certification that a required workplace hazard assessment had been performed in order to determine appropriate personal protective equipment (PPE) requirements, including but not limited to gloves, gowns, goggles, and face shields, for the treatment and direct patient care, including providing one to one services, therapies, and restraints or physical holds to COVID-19 positive adult and adolescent patients.
