29 CFR  1910.95(c)(1):The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 dBA (equivalent dose 50%)  On or about  May 12, 2021, employees were exposed to noise levels in excess of 85 decibels  on the A weighted scale  from pallet manufacturing activities. The employer did not ensure that affected employees were included in an effective hearing conservation program in accordance with the provision defined in 29 CFR 1910.95 (c)(1).  a) A laborer using tools such as, but not limited to, saws, and hammers was exposed to an 8-hour  TWA noise level of 90.4 dBA with an equivalent dose of 106.8 percent, during a 405 minute sampling period. Exposure calculations included a zero exposure increment for the 75 minutes not sampled.  b) A laborer using tools such as, but not limited to, saws, and hammers was exposed to an 8 hour  TWA noise level of 95.0 dBA with an equivalent dose of 200.3 percent, during a 397 minute sampling period. Exposure calculations included a zero exposure increment for the 83 minutes not sampled.  c) A laborer using tools such as, but not limited to, saws, and hammers was exposed to an 8 hour  TWA noise level of 90.2 dBA with an equivalent dose of 103.8 percent, during a 411 minute sampling period. Exposure calculations included a zero exposure increment for the 69 minutes not sampled.  d)  A laborer using tools such as, but not limited to, saws, and hammers was exposed to an 8 hour  TWA noise level of 92.6 dBA with an equivalent dose of 143.8 percent, during a 400 minute sampling period. Exposure calculations included a zero exposure increment for the 80 minutes not sampled.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19 (d)
