29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:   New residential construction located on Lot #185 at 225 Calebee Avenue, Senoia, GA 30276, Front side of the structure: On or about 04/27/2021, the employer exposed employees to struck-by hazards while operating the TranzSporter TP250 Material Hoist, in that protective helmets were not provided to the operator hoisting roofing shingles directly overhead to the roof above.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.   New residential construction located on Lot #185 at 225 Calebee Avenue, Senoia, GA 30276, Roof:  On or about 04/27/2021, the employer exposed employees to struck-by hazards while operating Metabo HPT NV45AB3 Roofing Nail Guns, in that protective eyewear was not provided to employees installing new roofing shingles operating these tools at 120 PSI.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  New residential construction located on Lot #185 at 225 Calebee Avenue, Senoia, GA 30276, Roof: On or about 04/27/2021, the employer exposed employees to falls of 10-feet, 4-inches to the lower level, in that a fall protection system was no used as employees were installing new shingles working an 8/12 pitched roof.  Candido Mendez Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1434802, citation number 1, item number 1 and was affirmed as a final order on 11/26/2019, with respect to a workplace located at 226 Brookview Drive, Lot 402, Newnan, GA 30265.  Candido Mendez Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1415851, citation number 1, item number 1 and was affirmed as a final order on 08/28/2019, with respect to a workplace located at 206 Brookview Drive, Lot 407, Newnan, GA 30265.
