29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) 4425 Merrigold Way (Lot 63): On or about 4/22/2021, the employer exposed employees to struck-by hazards, in that an employee was throwing boards and other materials from a roof at a height of approximately 25 feet above ground level while another employee was at the base of the pump jack scaffold post and not wearing a hard hat.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) 4425 Merrigold Way (Lot 63): On or about 4/22/2021, the employer exposed an employee to a fall hazard of approximately 25 feet above ground level, in that a fall protection system was not provided while he was on a 8:12 pitch roof disconnecting anchor points for the pump jack scaffold and cleaning up materials.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: a) 4425 Merrigold Way (lot 63): On or about 4/22/2021, and at times prior, the employer exposed an employee to fall hazards on a 8:12 pitch roof at a height of approximately 25 feet in that training was not provided on the recognition of fall hazards and the measures needed to prevent them. The employee was disconnecting pump jack scaffold anchors and cleaning up materials.
