29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames,  or uprights did not bear on base plates and mud sills or other adequate firm foundation:  a) On or about March 3, 2026, the employer exposed employees to collapse/fall hazards of approximately 17-feet to the lower level, in that the pump jack scaffold posts did not rest on base plates and mud sills or other adequate firm foundation.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees:  a) On or about March 3, 2026, the employer exposed employees to collapse/fall hazards of approximately 17-feet to the lower level, in that 2x4s were used as a makeshift ladder jack to support a work platform which was resting on the rungs of an extension ladder in an area where a pump jack pole could not be utilized to install siding materials.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a) On or about March 3, 2026, and at times prior, the employer exposed employees to fall hazards of approximately 17 feet to the lower level, in that employees were not provided fall protection while working from the scaffold system engaged in siding activities.   Miguel Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii), which was contained in OSHA inspection number 1561392, citation number 1, item number 1, and was affirmed as a final order on  02-15-2022, with respect to a workplace located at 267 Quail Pass, Lot 118, Sosbee Creek, Dawsonville, GA 30534.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On or about March 3, 2026, and at times prior, the employer exposed employees to fall hazards of approximately 10 feet to the lower level, in that employees were not provided fall protection while standing on a lower roof engaged in siding activities.   Miguel Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1528060, citation number 1, item number 2, and was affirmed as a final order on  09-20-2021, with respect to a workplace located at 4425 Merrigold Way, Fairburn, GA 30213.

29 CFR 1926.403(b)(1): Employer did not ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees:   a) On or about March 3, 2026, and at times prior, the employer failed to inspect all electrical extension cords used to provide power to electric tools which employees engaged in siding operations were using, in that the yellow extension cord powering the air compressor and circular saws was damaged. An inspection of these cords was not performed prior to the shift as these cords were not repaired or removed from service.
