29 CFR  1910.29(b)(2):  The employer did not ensure that guardrail systems met the requirement that  midrails, screens, mesh, intermediate vertical members, solid panels, or equivalent intermediate members that are installed between the walking-working surface and the top edge of the guardrail system as follows when there is not a wall or parapet that is at least 21 inches (53 cm) high.  A) C.H.A.T of Pennsylvania, On or about May 05, 2021 at the address of 5650 Wattsburg Rd., Erie, PA: The employer did not ensure that employees were provided with proper fall protection while working from heights greater than 4 feet. Employees were utilizing a makeshift man basket attachment for a forklift, without any type of mid rail in place for employees to utilize as fall protection.

A) C.H.A.T of Pennsylvania, On or about May 05, 2021 at the address of 5650 Wattsburg Rd., Erie, PA: The employer did not provide fire extinguisher training to employees. The employees had previously never been trained on how to use the fire extinguishers in the facility, but were expected to use them during incipient stage fires.

Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  A) C.H.A.T of Pennsylvania, On or about May 05, 2021 at the address of 5650 Wattsburg Rd., Erie, PA:  A Hyster forklift was being used with a man-lift attachment. The attachment was used for activities including, but not limited to, lifting employees for rack teardown. The company had not received the forklift manufacture's approval to use this attachment.

29 CFR  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, employees were exposed to amputation hazards and related struck-by/caught between hazards from falls associated with a forklift attachment that was not positively secured to the forklift and not equipped with guarding devices:  A) C.H.A.T of Pennsylvania, On or about May 05, 2021 at the address of 5650 Wattsburg Rd., Erie, PA:  employees were exposed to struck by, caught between, crushing hazards, and fall hazards while working from an elevated work platform that was not attached to the forklift. Employees worked between 4-10 feet on the elevated platform with nothing securing the platform to the forks of the Hyster forklift.  In addition, devices were not utilized to keep employees body parts out of the forklift's lifting components.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
