OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards from the missing/broken safety latches on below the hook lifting devices:  A.) C.H.A.T. of PA, Inc., Engine Bay, On or about 7/10/25 and times prior thereto:  Employees operated cranes at the site to move material including but not limited to locomotive engines.  Cranes include but are not  limited to the Wolverine 44 Ton crane.  Employees were exposed to accidental displacement of the load and struck-by hazards as a result of a missing safety latch on the hook of the BLT Inc 4200 lb. spreader bar under the hook lifting attachment.     ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

29 CFR  1910.178(a)(4):Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   A.) C.H.A.T. of PA, Inc., On or about 7/10/25 and times prior thereto: a cage lifting attachment was being used with sit down forklifts including, but not limited to, Toyota Forklift Model 8FGCU25 Serial Number 81169 .  The attachment was used for work operations including, but not limited to, checking for leaks in pipes.    The employer had not received prior written permission from the forklift manufacturer to use the attachment.  B.) C.H.A.T. of PA, Inc., On or about 7/10/25 and times prior thereto: Fork extender attachment were being used with sit down forklifts including, but not limited to, Toyota Forklift Model 8FGCU25 Serial Number 81169 .  The attachment was used to pick up longer material.  The employer had not received prior written permission from the forklift manufacturer to use the attachment.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
