29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about May 15, 2021, the employer did not ensure that ladders used for access to an upper landing surface had the side rails extended at least 3 feet above the landing surface. Employees of Pecas Construction, LLC., were exposed to fall hazards greater than 12.5 feet, in that the ladder used to descend from the roof extended only 1 ft. above the landing surface. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about May 15, 2021, the employer did not ensure that each employee(s) engaged in residential construction activities 6 feet or more above lower levels were protected by guardrails, safety nets, or personal fall arrest systems. Employees of Pecas Construction, LLC., were exposed to fall hazards greater than 12.5 feet, while engaged in residential framing activities. Employees were not using fall protection equipment. Abatement Note: Abatement certification and documentation required for this item (see enclosed "Certification of Corrective Action Worksheet"). Pecas Construction, LLC was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1326941, citation number 1, item number 2 and was affirmed as a final order on August 15, 2018, with respect to a workplace located at 3709 White Rose Loop, Castle Rock, CO 80108.
