29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Employees were using a pneumatic nail guns and circular saws while framing a house. The employees were not utilizing eye protection, thereby exposing employees to struck-by hazards to the eyes.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees who used electrically operated tools and equipment were protected from electrical contact hazards. Framers were using an extension cord with the ground prong missing from the end of a cord, which exposed the employees to a 121 volt electrical contact hazard.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees were trained on the recognition of fall hazards or the correct procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were framing the second story, thereby exposed to fall hazards of 19 feet, 5 inches.

AKA Rojas Construction, was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1385399, citation number 1, item number 1a and was affirmed as a final order on May 7, 2019, with respect to a workplace located at 6729 North Hamilton Road, building #5, Westerville, OH 43081.

Employees were framing the second story. The employee did not have any means of fall protection, thereby exposed to fall hazards of up to 19 feet, 5 inches.  b) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees used the first floor to access the second story where the basement opening was unguarded, thereby exposed to fall hazards of up to 10 feet.  c) Agners Framing Construction LLC., at a jobsite located at 161 Crimson Drive, Lot 13478, Newark, Ohio 43055: On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees accessed the second story where the first story wall openings were unguarded, thereby exposed to fall hazards of up to 10 feet, 11 inches.  Agners Framing Construction LLC.
