29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  a.  Located at 260 Whitetail Trail, Johnstown, OH 43031: Agners Framing Construction did not provide and enforce an accident prevention program designed to mitigate common construction hazards such as falls and struck-by hazards.  Employees were not protected by training, PPE, or accident avoidance/prevention programs while working at heights and with pneumatic equipment.  Agners Framing Construction LLC., was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1531517, citation number 2, item number 1 and was affirmed as a final order on July 7, 2021, with respect to a workplace located at 161 Crimson Drive, Newark, OH 43055.  Rojas Construction, was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1385399, citation number 1, item number 1a and was affirmed as a final order on May 7, 2019, with respect to a workplace located at 6729 North Hamilton Road, building #5, Westerville, OH 43081.

Located at 260 Whitetail Trail, Johnstown, OH 43031: Agners Framing Construction did not enforce the use of eye protection for employees exposed to flying particles resulting from the operation of a pneumatic nail gun.  Agners Framing Construction LLC., was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1531517, citation number 1, item number 1 and was affirmed as a final order on July 7, 2021, with respect to a workplace located at 161 Crimson Drive, Newark, OH 43055.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure:  a.  Located at 260 Whitetail Trail, Johnstown, OH 43031: Agners Framing Construction employees working on joists at a height of approximately 10' on a residential construction project were not protected from fall hazards.  b.  Located at 260 Whitetail Trail, Johnstown, OH 43031:  Agners Framing Construction employees working on the first floor and joists of a residential construction project were not protected from fall hazards posed by an unguarded 10' staircase opening between the basement and first floor.  Agners Framing Construction LLC., was previously cited for a violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1531517, citation number 2, item number 3 and was affirmed as a final order on July 7, 2021, with respect to a workplace located at 161 Crimson Drive, Newark, OH 43055.
