29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Godoy Construction LLC., at a jobsite located at 100 Natalie, Lot 100, Pataskala, Ohio 43062 : On and/or preceding May 18, 2021, the employer did not maintain a safety and health program such as but not limited to a fall protection program to ensure detection and correction of hazards during construction activities.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Godoy Construction LLC., at a jobsite located at 100 Natalie, Lot 100, Pataskala, Ohio 43062 : On and/or preceding May 18, 2021, the employer did not ensure employees were trained on the recognition of fall hazards or the correct procedures required to be followed to minimize the fall hazards. Employees, without fall protection training, were framing the second story, thereby exposed to fall hazards of 10 feet, 4 inches.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Godoy Construction LLC., at a jobsite located at 100 Natalie, Lot 100, Pataskala, Ohio 43062 : On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees were framing the second story floor. The employee did not have any means of fall protection, thereby exposed to fall hazards of up to 10 feet, 4 inches.  b) Godoy Construction LLC., at a jobsite located at 100 Natalie, Lot 100, Pataskala, Ohio 43062 : On and/or preceding May 18, 2021, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employees used framing where the basement opening was unguarded, thereby exposed to fall hazards of up to 10 feet.
