29 CFR 1910.146(c)(5)(ii)(H): Employees entered into permit spaces that met the conditions set forth in 29 CFR 1910.146(c)(5)(i), but the employer did not verify that the space was safe for entry and that the measures required by 29 CFR 1910.146(c)(5)(ii): In the manufactured metal tanks, the employer exposed employees to health hazards by failing to verify the permit confined spaces were safe prior to entry by all requirements of the standard exposing employee to affixation hazards: 1. The employer did not verify the space was safe for entry and did not take measures required for confined space entry. 2. The employer failed to evaluate the workplace to determine if any spaces were permit-required confined spaces. 3. The employer did not periodically test as necessary the atmosphere within the space to ensure the continuous forced air ventilation would prevent the accumulation of a hazardous atmosphere. 4. The employer did not provide training so all employees working in confined spaces obtained the understanding, knowledge, and skills necessary for safe performance of the duties assigned.
