Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  On May 20, 2021 at a worksite located 218 Crestview Avenue, Neenah, WI 54956; employees engaged in residential construction activities, specifically roofing, were working approximately 9 feet above the lower ground level and were not protected by guardrail systems, safety net systems or personal fall arrest systems  a)  Three employees worked on the roof of the house; two employees installed flashing around a chimney and the third employee installed gutter guards and removed tools\materials from the roof. The employees were exposed to fall hazards from the edge of the roof to the ground below.  b)  Three employees worked on the roof of the detached garage conducting tear off and re-shingling. The roof anchor was installed with only two screws, was not installed into a truss, and was attached to two employees' lanyards. The employees were exposed to fall hazards from the edge of the roof to the ground below.  The Apple Roofing Solutions LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1314295, citation number 2, item number 1 and was affirmed as a final order on May 22, 2019, with respect to a workplace located at 3022 William Grant Drive, De Pere, WI 54115.  The Apple Roofing Solutions LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1266333, citation number 1, item number 1 and was affirmed as a final order on January 16, 2018, with respect to a workplace located at N3353 Hwy 55, Kaukauna, WI 54130.
