29 CFR  1926.502(d)(15): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed, and used as identified in standards 1926.502(d)(15)(i)-1926.502(d)(15)(ii).  a) On or about May 28, 2024, with respect to a worksite located at 2408/2410 Canter Lane, Green Bay, WI 54304, the employer did not ensure that roof anchor being used as part of fall protection system above the unit labeled 2408 had been installed correctly and would support at least 5,000 pounds per attached employee. There was not a sufficient amount of fasteners installed in the anchor point, as prescribed in the manufacturer's instructions.   b) On or about May 28, 2024, with respect to a worksite located at 2412/2414 Canter Lane, Green Bay, WI 54304, the employer did not ensure that roof anchor being used as part of fall protection system above the unit labeled 2412 had been installed correctly and would support at least 5,000 pounds per attached employee. The rope grab portion of the fall protection system was connected at the end of the rope which would not have prevented the employee from contacting the ground during a fall.   b) On or about May 28, 2024, with respect to a worksite located at 2412/2414 Canter Lane, Green Bay, WI 54304, the employer did not ensure the personal fall arrest systems were rigged so that the employees would not free fall more than 6 feet or contact the ground in the event of an unexpected fall. On or about May 28, 2024, with respect to a worksite located at 2408/2410 Canter Lane, Green Bay, WI 54304, an employee using a Gorilla Model GLMPXA-14 Multi-Position Ladder was exposed to fall hazards when the employer did not ensure that the employee used the ladder as designed. The employee was using the ladder in the step-ladder configuration and was observed standing on the top rung of each side of the ladder, increasing the chances of tipping the ladder during use.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a) Apple Roofing Solutions, LLC does not require the use of fall protection during roofing operations. This violation was most recently observed on May 28, 2024, at a residential re-roofing project located at 2408/2410 Canter Lane, Green Bay, WI 54304. Employees were exposed to falls hazards of 9 feet 4 inches and greater while tearing off old roofing materials and installing new asphalt shingles without their harnesses being connected to lifelines.  b) Apple Roofing Solutions, LLC does not require the use of fall protection during roofing operations. This violation was most recently observed on May 28, 2024, at a residential re-roofing project located at 2412/2414 Canter Lane, Green Bay, WI 54304. 29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a) On or about May 28, 2024, with respect to a worksite located at 2412/2414 Canter Lane, Green Bay, WI 54304, employees were exposed to falls of 9 feet, 4 inches while accessing the roof of a residential building using a Franklin Model 63418 Multi-Position Ladder that was not extended three feet above the landing surface nor was it secured to the roof with a grasping device provided.
