29 CFR  1910.178(q)(1):  Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:   Facility Loading Dock area/Charging Station:  The employer did not remove a Toyota forklift from service that was not in safe operating condition in that the seat was torn.  The forklift was used to transport pallets of materials to and from 18 wheeled trucks at the various loading docks to the inside staging area or sorting sections. Employees were exposed to struck-by and crushing hazards. Removal of unsafe equipment from the facility/shop ensures that employees do not use the equipment and place themselves or others in harms way.
