29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) On or about May 26, 2021, in the large bay where spray painting is performed, an employee was spray painting large pieces of equipment with primers and coating without a written respiratory protection program developed that included training on use of supplied air respirator and other program provisions in 1910.134(c)(1)(i)-(ix).

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  (a) On or about May 26, 2021, in the large bay where spray painting is performed, an employee was spray painting large pieces of equipment with primers and coating while wearing a supplied air respirator. The employee did not have a medical evaluation completed to verify fitness to use.

29 CFR  1910.1053(d)(1): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section:  (a) On or about May 26, 2021 in the large bay where sandblasting is performed, an employee was sandblasting large pieces of metal equipment with 2340 coarse industrial grade sand without having performed an initial determination of respirable crystalline silica exposure, potentially exposing them to respiratory hazards from crystalline silica.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about May 26, 2021, the employer did not develop and implement a written hazard communication program which outlined training requirements and procedures for handling hazardous chemicals that are used  in the facility to perform work tasks and potentially exposing employees to respiratory and dermal hazards.  Employees use an epoxy primer (R-Cure 200 Gray 2.8 VOC Fast Cure Epoxy Primer) to prep parts for spray painting.
