29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: The written hazard communication program was deficient in the following ways. Employees are exposed to chemical hazards. 1. The written program did not reflect the 2013 standard revisions to include a description of the pictogram system, the reasons for the standard revision, and the definition of Global Harmonization. 2. The methods the employer will use to provide employees on-site access to safety data sheets for each hazardous product used and/or supplied to them. 3. A description of the labelling system used in the work place.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical. Fire Cache - Safety Data Sheets (SDS's) for hazardous chemicals such as flammable paints, thinners, acetone, and various lubricants were not maintained as required. Employees are exposed to physical and health hazards associated with these products.

29 CFR 1910.1200(h)(3)(iv): Employees had not been provided with GHS 2012 training including an explanation of the labels received on shipped containers and the workplace labeling system to be used by their employer; the safety data sheet, including the order of information, and how employees can obtain and use the appropriate hazard information: The employer failed to train potentially exposed employees on the new label elements (i.e. pictograms and signal words) and the new SDS formation by 12/2/13 as required by the revised Hazard Communication Standard. Employees use hazardous chemicals such as flammable paints, thinners, and fuel as well as lubricants and cleaning products. Employees were exposed to chemical hazards.
