29 CFR  1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set.   a) 242 Harrison St, Paterson, NJ/Exterior of Building: The employer  left the worksite  with the Lull rough terrain forklift boom extended with plywood on the roof of a three story building,  on or about 5/25/2021.   . Mr. Zaruma stated that he was operating the LULL rough terrain forklift onsite. Mr. Zaruma stated that he left the worksite with the forklift boom extended with plywood on the roof of the building. Mr. Zaruma stated that he went to Advantage lumber to get materials. .  Employees without any means of fall protection were exposed to fall hazards  of approximately 35 feet above the ground while engaged in framing activities,

Datty's Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.102(a)(1), which was contained in OSHA inspection number 1490803, citation number 1, item number 3 and was affirmed as a final order on 2/04/2021, with respect to a workplace located at 216 Spring St, Paterson, NJ 07503.
