29 CFR 1926.451(a)(6):  Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.  Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section:  Construction site: On 5/24/2021, employees of Barrera Construction LLC were constructing a commercial building located at 1620 Veterans Memorial Parkway, Wright City, Missouri.  The employer does not ensure that scaffolds are designed by a qualified person and are constructed and loaded in accordance with that design.  A three quarter inch piece of plywood was used as a scaffold platform and placed on top a wooden pallet which was being lifted by a JCB 508C telescopic handler to heights in excess of 10 feet.  The scaffold platform exposed employees to trip hazards along with fall hazards while working at heights on the platform.

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  Construction site: On 5/24/2021, employees of Barrera Construction LLC were constructing a commercial building located at 1620 Veterans Memorial Parkway, Wright City, Missouri.  The scaffold and scaffold components were not being inspected by a competent person for visible defects which could affect structural integrity.  Employees were exposed to fall hazards, trip hazards and floor holes located on the scaffold platform.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform is not attached to the fork or the fork-lift is moved horizontally while the platform is occupied:  Construction site: On 5/24/2021, employees of Barrera Construction LLC were constructing a commercial building located at 1620 Veterans Memorial Parkway, Wright City, Missouri.  The employees were exposed to fall hazards while working from a scaffold platform which was elevated into position by a JCB 508C Telehandler.  The platform and employees were observed traveling horizontally as the JCB Telehandler was repositioning the platform.  The scaffold platform was insufficiently connected by two Husky nylon ratchet straps which went around the plywood and the fork carriage assembly.

29 CFR 1926.451(g)(l)(vii):  For all scaffolds not otherwise specified in paragraphs (g)(l)(i) through (g)(l)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  Construction site: On 5/24/2021, employees of Barrera Construction LLC were constructing a commercial building located at 1620 Veterans Memorial Parkway, Wright City, Missouri.  The employer does not ensure that employees working from scaffolds are protected with the use of a personal fall arrest system or guardrails system.  Two employees were observed working from a scaffold platform which was lifted by a JCB 508C Telehandler fork lift.  The employees were exposed to elevated heights of 11 feet or more without a personal fall arrest system or guardrail systems in place.

29 CFR 1926.454(a):  The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  Construction site: On 5/24/2021, employees of Barrera Construction LLC were constructing a commercial building located at 1620 Veterans Memorial Parkway, Wright City, Missouri.  The employer did not train employees on the applicable standards or procedures to be followed in order to minimize and recognize scaffolding hazards.  The crew was operating two Skyjack scissor lifts and one JCB 508C Telehandler forklift while constructing the building.

29 CFR 1926.602(d): The employer did not train powered industrial truck drivers as required by paragraph 29 CFR 1910.178(l):  Construction site: On 5/24/2021, employees of Barrera Construction LLC were constructing a commercial building located at 1620 Veterans Memorial Parkway, Wright City, Missouri.  The employee operating the JCB Loadall Telehandler Rough Terrain Fork Lift Model # 508C, Serial # SLP508C02E0587212, to elevate a scaffold platform with two workers greater than 10 feet high was not a qualified fork lift operator.  Note: The requirements applicable to construction work under paragraph (d) of this section are identical to those set forth at paragraph (l) of 29 CFR 1910.178.
