29 CFR  1926.20(b)(1):The employer did not initiate and maintain such programs as may be necessary to comply with this part.  a) MDM & Sons Construction, LLC, conducting work at 549 Canterbury Blvd Perrysburg, Ohio: On or about May 27, 2021, the employer did not have a safety and health program to identify job site hazard's which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during job site operations.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) MDM & Sons Construction, LLC, conducting work at 549 Canterbury Blvd Perrysburg, Ohio: On or about May 27, 2021, the employer did not ensure employees had been trained in the appropriate use of fall protection such as, but not limited to the use of personal fall arrest systems or alternative measures while performing operations, including but not limited to laying roof sheeting. Such training would help the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls during job site operations. Employees in this condition were exposed to falls up to 25 ft.

29 CFR  1926.95(a):Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.  a) MDM & Sons Construction, LLC, conducting work at 549 Canterbury Blvd Perrysburg, Ohio:  On or about May 27, 2021, the employer did not ensure that employees were using appropriate eye protection while conducting construction work equipment such as, but not limited to high powered pneumatic nail guns.  Employees were exposed to the hazards of eye injury from foreign objects entering the eye.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) MDM & Sons Construction, LLC, The employer does not require the use of any form of fall protection during roofing work. The violation was most recently observed at 549 Canterbury Blvd Perrysburg, Ohio, where employees were not protected from a 25 foot fall to the ground below. To abate this hazard the employer must ensure that its employees performing roofing work are protected from falls, and no employees are allowed onto a roof more than 6 feet high without adequate fall protection.
