29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  (a)	 On May 21, 2021, and at times prior, where the employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed at 100 East Wachter Avenue in Bismarck, North Dakota where employees were not protected from fall hazards of up to 22 feet while performing roofing activities. To abate this violation, the employer must ensure that its employee's performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1480342, Citation 1, Item 1, and was affirmed as a final order on February 8, 2021, with respect to a workplace located at or near 320 East Wachter Avenue in Bismarck, North Dakota.   Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1485583, Citation 1, Item 1, and was affirmed as a final order on February 3, 2021, with respect to a workplace located at or near 1665 Pocatello Drive in Bismarck, North Dakota.   Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1485580, Citation 1, Item 1, and was affirmed as a final order on February 3, 2021, with respect to a workplace located at or near 225 East Wachter Avenue in Bismarck, North Dakota.
