29 CFR  1910.119(f)(4):The employer did not develop and implement safe work practices to provide for the control of hazards during operations such as lockout/tagout; confined space entry; opening process equipment or piping; and control over entrance into a facility by maintenance, contractor, laboratory, or other support personnel:  Instance A: On or about March 19, 2021, the employer did not implement safe work practices by ensuring permits were created during removal and re-installation of the drain line on the Depropanizer Column V3780 to the process sewer so that hazards could be identified and controlled during confined space entries.  Instance B: On or about April 1, 2021, a flash fire occurred in a condensate line during welding activities and the employer did not implement safe work practices by ensuring piping was free of flammable hydrocarbons prior to allowing intense hot work activities to be conducted.

29 CFR  1910.146(d)(3)(iii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including isolating the permit space:   On or about March 19, 2021,  employees entered the Depropanizer Column Vessel #3780 without the employer developing and implementing the means, procedures, and practices necessary to ensure closure of a drain line to a process sewer prior to allowing employees in the space to conduct grinding operation.

Instances C:  On or before June 3, 2021, the employer failed to retain canceled entry permit #WR-CSEP-21-33670 at least one year to facilitate the review of the permit-required confined space program.
