OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in and crushed-by hazards when an overridden safety switch did not shut down the conveyor line when the access door was opened.   a)  At the keg up-ender, on or about June 2, 2021, and at times prior to, the employer failed to ensure employees were protected and not exposed to caught-in and crushed-by hazards from an unguarded conveyor chain and point of operation at the keg up-ender when an access door was opened due to a safety switch being overridden with a force placed in the logic.

29 CFR  1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.    a)  At the keg up-ender. on or about June 2, 2021, the employer failed to ensure the point of operation was guarded on the keg up-ender, in that the safety switch did not deactivate the machine when the door was opened, thereby exposing employees to caught-in and crushed-by hazards from rotating parts.

29 CFR  1910.212(a)(3)(iii): 29 CFR 1910.212(a)(3)(iii):  Special hand tools for placing and removing material(s) were used in lieu of other guarding required by this section, permitting the operator to place a hand in the danger zone:  a)  At the keg up-ender. on or about June 2, 2021, the employer failed to ensure the the keg up-ender was deactivated, in that the safety switch did not shut down the machine when the door was opened and the employees used hand tools to clear jams near the point of operation, thereby exposing employees to caught-in and crushed-by hazards.
