29 CFR 1910.134(f)(2):Employee(s) using a tight-fitting facepiece respirator were not annually fit tested: (Construction Reference 1926.103) a) Building Systems, Inc., 150 West 10th Street in Erie, Pennsylvania. - On or about June 9,2021, and at times prior thereto, an employee required to utilize a 3M Brand tight fitting air purifying respirator, with P100 particulate filters, was not provided annual fit-testing. Fit-testing was last provided February 20, 2020. Respirators were required when cleaning or working near contractors conducting operations including, but not limited to, painting, sanding, and grinding. ABATEMENT COMPLETE

29 CFR 1910.1200(e)(1): The employer did not maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59) a) Building Systems, Inc., 150 West 10th Street in Erie, Pennsylvania. - On or about June 9,2021, and at times prior thereto: A copy of the written Hazard Communication Program was not available at the worksite. Employees worked with and/or were potentially exposed to chemicals that included, but were not limited to, xylene, ethylbenzene, and nuisance dust while working with and/or near contractors performing operations including, but not limited to, painting, sanding, and grinding. Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
