29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use. On or about June 9, 2021, and at times prior thereto, employees were required to wear N95 filtering facepiece respirators without the implementation of a Respiratory Protection Program, exposing employees to the hazards of increased physiological burden, aggravation of a cardiac or pulmonary disorder, and inhaling respirable silica dust.

29 CFR 1910.1053(j)(3)(i): The employer did ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica; specific tasks in the workplace that could result in exposure to respirable crystalline silica; specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica; the contents of this section; and the purpose and a description of the medical surveillance program required by paragraph (i) of this section. On or about June 9, 2021, and at times prior thereto, employees who are exposed to high levels of respirable crystalline silica during countertop fabrication were unable to demonstrate knowledge of either the health hazards of silica exposure or of a medical surveillance program, exposing employees to the hazard of unmonitored development or augmentation of lung damage.
