29 CFR 1926.501(b)(11):Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a. On or about June 12, 2021, and at times prior, at the west side of the building, the employer exposed subcontracted employees of Inversiones R.A.L. 23 LLC to a 32 feet fall hazard, in that an employee performing roofing work on a 9:12 pitch roof was not wearing a personal fall arrest system. b. On or about June 12, 2021, and at times prior, at the west side of the building, the employer exposed subcontracted employees of Inversiones R.A.L. 23 LLC to a 32 feet fall hazard, in that two employees performing roofing work on a 9:12 pitch roof were not wearing their personal fall arrest systems as intended and according to manufacturer's instructions. The employees were not connected to the D-ring at the back, but on components of their body harness.

29 CFR 1926.503(a)(2)(ii):The employer did not assure that each employee, as necessary, had been trained by a competent person in the correct procedures for erecting, maintaining, disassembling and inspecting the fall protection systems to be used: a. On or about June 12, 2021, at the west side of the building, the employer exposed sub-contracted employees to a fall hazard of 32 feet in that employees were not trained by a competent person in the correct procedures for erecting, maintaining and inspecting the fall protection system on the 9:12 pitch roofing job at the site.
