29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  New residential construction located on Lot #6, Front of structure: On or about 6/17/2021, and at times prior, the employer exposed employees to fall hazards up to 7 feet 2 inches to the lower level, in that a ladder or other safe means of access to the scaffold working platform was not provided. Employees climbed masonry walk -through scaffold type frames to access the working level.

29 CFR  1926.451(f)(7):Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:; Such activities were not performed only by experienced and trained employees selected for such work by the competent person.  a)	New Residential construction, front exterior wall, Lot 6:  On or about 6/17/2021, and at times prior, the employer exposed employees to fall and collapse hazards, in that a tubular welded frame scaffold was being used by employees to perform bricklaying work and was not inspected by a competent person. The mason crew had been working in the area for three days.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a)     New residential construction, LOT 6, Roof:  On or about 6/17/2020, and at times prior, the employer exposed employees to fall hazards, in that a complete fall protection system was not provided to employees who were conducting masonry activities on a 4:12 pitched roof at heights measured at 12 feet 6 inches to the lower level. Employees were in the process of bricklaying.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards  a) New residential construction, lot 6, roof: On or about 6/17/2021, and at times prior, the employer exposed employees to fall hazards of 12 feet 6 inches to the lower level, in that the employer did not provide fall protection training to employees working on the roof conducting masonry activities. Employees were not trained to recognize whether a fall hazard existed.
