29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"): a) Colorado Counter-Tops, Inc., 3556 Quentin Street, Aurora, CO 80011: On and before June 17, 2021, the employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. Employees were required to wear Moldex R95 particulate respirators when working in the granite department/grinding and polishing/buffing, solid surface department/ sanding and polishing/ buffing, and dust collector/emptying the bags. Employees were not provided a medical evaluation prior to use. This condition exposed employees to respiratory hazards.

29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v): a) Colorado Counter-Tops, Inc., 3556 Quentin Street, Aurora, CO 80011: On and before June 17, 2021, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the correct name of the chemical and appropriate hazard information. Secondary containers were not provided with labels nor was marked with the identification of hazard and other required information of the content of at least, but not limited to these observed containers: A spray bottle containing a clear liquid had handwritten on its side "SEALANT" and nothing else. A spray bottle containing a clear liquid had handwritten on its side "LER" and nothing else. spray bottle containing a clear liquid had handwritten on its side "Limpieza" ("cleaning") and a date. A squirt bottle containing a clear liquid had a deteriorated label that read "1100 Paint Lacquer Thinner." Two squirt bottles containing a clear liquid and a piece of blue tape wrapped around them had no legible label. A red safety can described as lacquer thinner had no legible label. This condition exposed employees to chemical hazards. b) Colorado Counter-Tops, Inc., 3556 Quentin Street, Aurora, CO 80011: On and before June 17, 2021, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the correct name of the chemical and appropriate hazard information. A large storage tank containing a mixture of perlite and water known as "polishing water" had handwritten on its side "Limpieza" (translates into cleaning) and a date. There was no label marked with the identification of hazard information of the content. This condition exposed employees to a chemical hazard.

Employees did not understand what chemicals were in secondary containers except that they were being used as cleaners in the polishing area. This condition exposed employees to chemical hazards.

Chemicals found in the workplace for which the employer did not have an SDS included, but were not limited, to the following: 1. Trade Name 1100, solvent (contains toluene; flammable, toxic, irritant) 2. Wilsonart Lokweld Wood Glue (slightly corrosive, toxic, and flammable) This condition exposed employees to a chemical hazard.
