29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) New residential construction, LOT 240, Roof: On or about 6/23/2021, and at times prior, the employer exposed employees to struck by hazards , in that they are operating a Hitachi NV45AB2 1-3/4 coil nail gun at 70 PSI without eye protection. Safety glasses were not provided to employees while conducting roofing activities prior to the beginning of the work day.

29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, LOT 240, Roof: On or about 6/23/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided employee who were conducting roofing activities on a 12:12 pitched roof at heights measured at 18 feet to the lower level. Employees were installing shingles on the roof.

29 CFR 1926.552(a)(1):The employer did not comply with manufacturer's specifications and limitations applicable to the operation of all hoists and elevators: (a) New residential construction, Lot 240, Front of residence to roof, On or about 6/23/2021, and at times prior the employer allowed employees to use the TranzSporter (Model LH250) Platform Hoist as a ladder to access the roof to install shingles. Manufacturer's general safety instructions state that this hoist should never be used as a ladder.
