29 CFR  1926.102(a)(1):29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a. At or near the intersection of Lone Pine Dr. and Sherman Ave., Berkeley Heights, NJ   The employer did not ensure employees operating  powered equipment used eye and face protection when exposed to hazards from flying particles.  Employees engaged in the removal and installation of sidewalks operated an American Pneumatic Tools jack hammer and a gas powered Stihl chop saw and were not utilizing any form of face and eye protection.   Violation observed on or about June 25, 2021

29 CFR  1926.302(b)(1):Pneumatic power tool(s) were not secured to the hose or whip by some positive means to prevent the tool from becoming accidentally disconnected:  a. At or near the intersection of Lone Pine Dr. and Sherman Ave., Berkeley Heights, NJ   The employer did not ensure that pneumatic power tools were secured  with a whip check (aka Air Hose Safety Cables) to the hose to prevent the tool from becoming accidentally disconnected.  Employee engaged in the removal of curbs used an American Pneumatic Tools jack hammer which did not have a whip check attached to the equipment to prevent the hose from coming disconnected from the tool when in use.   Violation observed on or about June 25, 2021

29 CFR  1926.302(b)(2): Safety clips or retainers were not securely installed or maintained on pneumatic impact (percussion) tools to prevent attachments from being accidentally expelled:  a. At or near the intersection of Lone Pine Dr. and Sherman Ave., Berkeley Heights, NJ   The employer did not ensure that pneumatic power tools had safety clips/retainers attached to the hose to prevent the tool from becoming accidentally expelled during use.  Employee engaged in the removal of curbs used an American Pneumatic Tools jack hammer which did not have safety clips installed to the hose connections at the Ingersoll Rand 185 CFM compressor  the jack hammer to prevent the attachment from becoming disconnected when in use.   Violation observed on or about June 25, 2021

29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:   a. At or near the intersection of Lone Pine Dr. and Sherman Ave., Berkeley Heights, NJ   The employer did not ensure measures were implemented to limit the exposure to respirable crystalline silica.  Employees engaged in the removal of concrete curbs and sidewalk sections used American Pneumatic Tools jack hammer and Stihl, TS-420 Cutquik� saw that created silica dust clouds where the employees did not have respiratory protection and were not using wet methods to control the dust as outlined in Table 1.   Violation observed on or about June 25, 2021
