On or about June 13, 2021, employees of Pacur, LLC were not inspecting ladders before initial use to ensure that no defect or other condition existed that would render the ladder unsafe to use.

29 CFR 1910.28(b)(1)(i):(1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by guardrail systems, safety net systems or Personal Fall Arrest Systems (PFAS). On or about June 13, 2021, an employee was exposed to falls of seven feet while conducting cleaning activities on the Trim Hopper and Trim Auger of Line 23 . The employee was standing on top of the extruder and was not protected by guardrail systems, safety net systems or Personal Fall Arrest Systems (PFAS).
