29 CFR 1910.132(f)(1)(iv): The employer shall provide training to each employee who is required by this section to use PPE. Each employee shall be trained on the limitations of the PPE.  On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; employees were provided cut resistant gloves without being trained in the potential entanglement and caught-in hazards created by rotating parts and processes such as, but not limited to, indexing rolls of plastic sheeting on the Winder machines.

On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; the employer did not ensure only safely arranged loads were handled when an employee utilized a forklift to move two pallets at the same time, one on each fork.

On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; the Mitsubishi FGC20CN1 (Serial Number: AF81F60121) LP forklift was available for use and was not removed from service after it was identified that the truck was moving and rocking unsteadily from side to side while driving forward.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.  On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; a replacement fork on the Linde electrical forklift #E3 (Serial Number: A1X346F00213/2015) was altered so that the relative positions of the various parts were different from the original manufacturer. The forks on the truck were different heights, causing the loads to lean during transit, potentially exposing pedestrian employees to being struck by unstable loads falling from the forks.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.   On or about August 18, 2022, and at times prior, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; the employer did not ensure that each powered industrial truck was examined before being placed in service or was not removed from service if the examination showed any condition adversely affecting the safety of the vehicle. When defects such as, but not limited to, mismatched fork sizes, unexpected movement from side-to-side while in operation, inoperable horns, and missing control arm panels were found, they were not immediately reported and/or corrected.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a) On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; employees utilizing the Lift Products Max-Tilt Hydraulic Tilt Upender LPTT-UP-30-90 were exposed to crushing hazards created by the rotating movement of the tilting mechanism and the material platform. The machine was not effectively guarded to prevent exposure to this hazard.  b) On or about August 19, 2022, At an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Extrusion Operator employees on the Welex SL6 Winder were exposed to entanglement and caught-in hazards created by the rotating shaft, the core, and the plastic sheet. The machine was not effectively guarded to prevent exposure to these hazards on both the platform on the winder and on the outfeed side of the winder.  c) On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Material Handler employees in the area of the Core Cutter #1 were exposed to caught-in hazards created by the unguarded chain and sprocket, and the belt and pulley on the drive motor that powers the spindle and core pusher. The machine was not effectively guarded to prevent exposure to this hazard.  d) On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Material Handler employees operating the Core Cutter #1 were exposed to caught-in and pinch point hazards created by the unguarded rollers which resulted in an ingoing nip point when the cutting blade contacted the core being cut. The machine was not effectively guarded to prevent exposure to these hazards.  e) On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Material Handler employees operating the Core Cutter #2 were exposed to caught-in and pinch point hazards created by the unguarded rollers which resulted in an ingoing nip point when the cutting blade contacted the core being cut. The machine was not effectively guarded to prevent exposure to these hazards.  f) On or about October 30, 2022, At an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Extrusion Operator employees on the SL3 Winder were exposed to entanglement and caught-in hazards created by the rotating shaft, the core, and the plastic sheet. The machine was not effectively guarded to prevent exposure to these hazards on both the platform on the winder and on the outfeed side of the winder.

The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.  a) On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Material Handler employees operating the Core Cutter #1 were exposed to amputation and laceration hazards created by the cutting blade when it automatically engaged to cut cardboard roll cores. The employer did not safeguard the point-of-operation to prevent operator access during normal production.  b) On or about August 19, 2022, at an establishment located at 3555 Moser Street in Oshkosh, Wisconsin; Material Handler employees operating the Core Cutter #2 were exposed to amputation and laceration hazards created by the cutting blade when it was activated with a foot pedal to cut cardboard roll cores. The employer did not safeguard the point-of-operation to prevent operator access during normal production.
