29 CFR 1926.1153(i)(2)(i)(A): The employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica: (a) Kiewit Infrastructure Co., at I-70 and Clayton Street, Denver, CO: On and preceding 6/24/2021, the employer did not ensure that each employee covered by this section could demonstrate knowledge and understanding of the health hazards associated with exposure to respirable crystalline silica. Employees demolished a concrete and rebar constructed elevated highway. Excavators were used to fracture concrete and remove sections of concrete. The process generated respirable crystalline silica. This condition exposed employees to a respirable crystalline silica hazard.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan: (a) Kiewit Infrastructure Co., at I-70 and Clayton Street, Denver, CO: On and preceding 6/24/2021, the employer did not establish and implement a written exposure control plan. Employees demolished a concrete and rebar constructed elevated highway. Excavators were used to fracture concrete and remove sections of concrete. The process generated respirable crystalline silica. The employer did not have a written workplace exposure control plan that included the elements required within 29 CFR 1926.1153(g)(1)(i) through (iv). This condition potentially exposed employees to a respirable crystalline silica hazard.
