29 CFR 1910.95(d)(1): When information indicates that any employee's exposure may equal or exceed an 8-hour time-weighted average of 85 decibels, the employer shall develop and implement a monitoring program. a) On or about July 22, 2021, the employer had not developed and implemented a noise monitoring program in the Soy Meal Processing area where employees were exposed to noise at 89 decibels for an 8-hour time-weighted average.

29 CFR 1910.95(d)(3)(i): Monitoring shall be repeated whenever a change in production, process, equipment or controls increases noise exposures to the extent that: Additional employees may be exposed at or above the action level. a) On or about July 22, 2021, the employer had not repeated monitoring in the bagging area for the additional noise from the new adjacent soy meal processing operation and the robotics area. Employees were exposed to noise at 90.5 decibels at an 8-hour time-weighted average.
