OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating automotive lifts: 1071 Rt 374 Dannemora, NY- On or about June 23, 2021, in that service area: Employees were exposed to struck-by and caught between hazards while working around and under three uninspected automotive lifts in the service area in that: a) The employer failed to inspect at minimum on an annual basis to ensure continued safe operation of the lift. b) The employer failed to inspect on a daily basis or take notice of the lift structure in a raised position to ensure proper operation of all features, in that Atlas Hydraulic automotive lift had leaking rams and hydraulic fittings affecting the ability to safely raise and control the lowering speed of the automotive lift from the raised position.
