29 CFR  1910.178(l)(2)(ii):Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a. On or before June 30, 2021, the employer failed to ensure an employee had training that consisted of formal instruction, practical training, and an evaluations of the operator's performance in the workplace. On January 6th, 2021, an employee was involved in a head on collision. The employee had not had any practical training with demonstrations performed by the trainer and practical exercises performed by the trainee, and had not had an evaluation of the operator's performance, thereby exposing employees to struck-by hazards.

On or before June 30, 2021, the employer failed to ensure employees had refresher training after employees were involved in an accident or near-miss incident. On January 6th, 2021, two employees were involved in a head on collision and returned to work without having had any refresher training, thereby exposing employees to struck-by hazards.

29 CFR  1910.178(l)(6):Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  a. On or before June 30, 2021, the employer failed to certify that each operator has been trained and evaluated. Employees operated forklifts without being certified, there-by exposing employees to struck-by hazard.
