29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  a) On or about June 30, 2021; the controlling employer, Headwaters Construction Company did not have an effective system in place to identify and correct hazards to which their subcontractors were exposed.  Hazards include a 16 foot fall from an interior mobile scaffold used for access up to the roof, where guardrails or other means of fall protection were not used.   b) On or about June 30, 2021; the controlling employer, Headwaters Construction Company did not have an effective system in place to identify and correct hazards to which their subcontractors were exposed. Hazards include a 27 foot fall hazard from the roof eaves where a means of fall protection was not used.    c) On or about June 30, 2021; the controlling employer, Headwaters Construction Company did not have an effective system in place to identify and correct hazards to which their subcontractors were exposed. Hazards include trip and fall hazards at the front entrance where the step was 26 inches high and a ramp or stair was not used.   d) On or about June 30, 2021; the controlling employer, Headwaters Construction Company did not have an effective system in place to identify and correct hazards to which their subcontractors were exposed. Hazards include lack of engineering controls when cutting clay brick that produces respirable crystalline silica.   Note) Certification of corrective action is required for these items.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501   a) On or about June 30, 2021; the controlling employer Headwaters Construction Company, did not ensure the roofing sub-contractor protected its employees from fall hazards while performing roofing activities on a 9 in 12 pitched roof.  The employees worked  without fall protection and were exposed to fall hazards over 25 feet to lower levels and the ground below.    b)  On or about June 30, 2021; the controlling employer Headwaters Construction Company, did not ensure the framing sub-contractor protected their employees from fall hazards while performing framing activities on a 9 in 12 pitched roof.  The employees worked without fall protection and were exposed to fall hazards over 25 feet to lower levels and the ground below. 29 CFR  1926.451(f)(15): Ladders were used on scaffolds to increase the working level height of employees: without satisfying the criteria of subparagraphs (i) - (iv) of this paragraph:  a) On or about June 30, 2021; the controlling employer Headwaters Construction Company provided and allowed sub-contractors employees to use an extension ladder on the top level of a mobile scaffold for access to the work area on the roof.   This exposed the employees to at least a 16 foot fall from the top scaffold plank.       Note) Certification of corrective action is required for this item.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a) On or about June 30, 2021; the controlling employer Headwaters Construction Company did not ensure its masonry sub-contractor protected their employees and other nearby subcontractor employees from respirable crystalline silica when cutting Summit clay brick. The controlling employer did not verify that the sub-contractor had a written exposure control plan and was implementing the elements of a plan.   Note) Certification and documentation of corrective action are required for this item.  Headwaters Construction Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1153 (c)(1), which was contained in OSHA inspection number 1330709, citation number 1 and was affirmed as a final order on September 6, 2018, with respect to a workplace located at East 3rd Street South, SODA SPRINGS, ID 83230
