29 CFR  1926.1053(b)(1): The employer failed to have the portable ladder's side rails extend at least 3 feet (.9 m) above the upper landing surface to gain access to the roof of the residential building.  On or about July 2, 2021 at the address of 2204 Farm View Court in Toledo, Ohio, the employer of Gedert Roofing and Repair LLC did not ensure that the portable ladder employees used to gain access to the roof was at least three feet above the upper landing surface of the roof of a residential building. Employees using the ladder to get on and off the roof were exposed to falls hazards of the ladder falling off the eave of the roof and employees experiencing a fall of approximately nine feet seven inches from the eave of the roof to the ground below when using the ladder.

29 CFR  1926.20(b)(1): The employer did not initiate and maintain a general safety and health programs as necessary to comply with this part.  On or about July 2, 2021 the employer did not have a program in place to identify hazards found in the job site. This program assists employees in maintaining a safe working environment and supports the employer and employees in identifying and avoiding potential hazards such as, but not limited to, falls from nine feet seven inches during jobsite operations.   Gedert Roofing & Repair LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(1), which was contained in OSHA Inspection Number 1479667, citation number 2,  item number 1a and was affirmed as a final order on August 20, 2020 with respect to a workplace located at 110 East Back Bay in Bowling Green, Ohio.  Gedert Roofing & Repair LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(1), which was contained in OSHA Inspection Number 1428244, citation number ,  item number 1 and was affirmed as a final order on November 14, 2019 with respect to a workplace located at 3516 Nordic Way Drive in Maumee Ohio.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards  On or about July 2, 2020 at the address of 2204 Farm View Court in Toledo, Ohio, the employer of Gedert Roofing and Repair LLC did not ensure that employees had been adequately trained in the appropriate use of fall protection. Employees were exposed to falls of approximately nine feet seven inches from the eave of the roof to the ground below while nailing shingles on the first story of a residential roof.  Gedert Roofing and Repair LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1479667, citation number 1, item number 1 and was affirmed as a final order on August 20, 2020, with respect to a workplace located at 110 East Back Bay in Bowling Green, Ohio.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or provided with an alternative fall protection measure under another provision of paragraph 1926.501  On or about July 2, 2021, the employer, at the address of 2204 Farm View Court in Toledo, Ohio, did not ensure employees were protected from fall hazards while nailing roofing material to the roof of a residential home. Employees working in this manner were exposed to falls of approximately nine feet seven inches at minimum from the eave of the roof to the ground below.  Gedert Roofing & Repair LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA Inspection Number 1479667, citation number 2,  item number 1 and was affirmed as a final order on August 20, 2020 with respect to a workplace located at 110 East Back Bay in Bowling Green, Ohio.
