29 CFR  1910.147(c)(4)(ii):  The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  (a)  On or about July 4, 2021, the New Wrapper Line, the energy control procedures did not specifically outline when entering Zone 2 that Zone 1 would be required to be de-energized exposing employees to struck by hazards.  (b)  On or about June 28, 2021, the New Wrapper Line, the energy control procedures did not specifically outline when entering Zone 3 that Zone 2 would be required to be de-energized exposing employees to struck by hazards.

29 CFR  1910.147(c)(7)(iii)(A):  Retraining shall be provided for all authorized and affected employees whenever there is a change in their job assignments, a change in machines, equipment or processes that present a new hazard, or when there is a change in the energy control procedures.  (a)  Employees/operators authorized to enter the zones of the New Wrapper Line were not trained in the energy control procedures exposing employees to accidental/inadvertent restart of the equipment.    (b)  Employees were also not trained on the Operation Task List per Zone Operating Procedure providing guidance for "Safe to Enter" procedures utilizing gated doors and light curtains exposing employees to accidental/inadvertent restart of equipment.

29 CFR  1910.147(d):  The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  On or about July 4, 2021, employees were exposed to machine hazards associated with moving parts when they engaged in cleaning activities on the New Wrapper Line.  The employer did not ensure that employees implemented energy control application steps prior to allowing them to enter Zones 2 while Zone 1 was still in operation.  The machine was not deenergized prior to the employee engaging in the servicing / maintenance activity.  As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine hazards.

29 CFR  1910.212(a)(1):  Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  (a)  On Zone 4 of the Wrap Line, expanded metal guarding had an opening of approximately 9" allowing employees to access unguarded moving parts.  (b)  In the New Wrapper Line, the Zone 3 control panel would allow for all zones to be reset before verification no employees were in the danger zone.   Zones 4, 5, and 6 were not visible but could be restarted.
