OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. a) Dry Department: On June 29, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled as rack 7, having bent/damaged supports, was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. b) Dry Department: On June 29, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled as rack 8, having bent/damaged supports, was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired.

29 CFR 1910.22(a)(1): The employer did not ensure that all places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition. a) Warehouse: On or about June 29, 2021, and at times prior, employees were exposed to slip and trip hazards, in that the employer had not developed and implemented an effective housekeeping policy where solid and liquid waste was allowed to accumulate on the floor.
