29 CFR  1910.178(p)(1): Employer allowed employees to operate a powered industrial truck (PIT) that was found to be in need of repair, defective and unsafe, the truck was not taken out of service until it had been restored to safe operating condition;  On or about and times prior to August 12, 2021 the employees were allowed to operate a LP powered industrial truck (PIT) that did not have a load rest (unstable load hazard) and the condition of the rear tires showed signs of extreme damage (worn beyond usefulness).

29 CFR  1910.178(q)(7): Employer failed to ensure that Industrial trucks  be examined before being placed in service and defects found were reported and corrected:  On or about August12, 2021 and times prior to, the employees were allowed to operate a LP powered industrial truck with tires that  showed signs of extreme damage (worn beyond usefulness).

29 CFR  1910.1200(g)(8):The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, nor ensure that they are readily accessible during each work shift to employees when they are in their work area(s). (Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.)  On or about and times prior to August 12, 2021, the employees were not provided access to the Safety Data Sheets for the hazardous chemicals being used/shipped/stored in the workplace. Chemicals used/shipped/stored at the site include: but are not limited to, compressed gases (Propane), corrosives, detergents and bleach..
