29 CFR 1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system: (a) Hector Lopez at 3009 West Russell Avenue, Sioux Falls, SD 57104: On or about and at times prior to July 7, 2021, the exposing employer did not ensure that employees conducting roofing operations on a commercial property were protected from falls. Employees were conducting tear off and shingling operations with fall protection systems installed but not connected. This condition exposed employees to fall hazards of greater than 17 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) Hector Lopez at 3009 West Russell Avenue, Sioux Falls, SD 57104: On or about and at times prior to July 7, 2021, the exposing employer did not ensure that employees were trained on the use of fall protection systems or how to recognize the hazards and/or procedures to be followed in order to minimize these hazards. This condition exposed employees to fall hazards and improper use of provided equipment.
