29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary:  (a) On or about July 14, 2021, an employee working on the second tier of self-supported tubular welded end frame scaffolding was not protected from a fall hazard of approximately fourteen (14) feet in that the scaffolding was not fully planked.  (b) On or about July 14, 2021, an employee working on the second tier at a corner of self-supported tubular welded end frame scaffolding was not protected from a fall hazard of approximately fourteen (14) feet in that the scaffolding was not fully planked.

29 CFR 1926.451(b)(3):The front edge of all platforms was not 14 inches (36 cm) or less from the face of the work, and no guardrail systems were erected along the front edge and/or no personal fall arrest systems were used in accordance with paragraph (g) of this section to protect employees from falling: Note:  See exceptions in paragraphs (b)(3)(i) and (ii) of this section.  (a) On or about July 14, 2021, an employee working on the second tier of self-supported tubular welded end frame scaffolding was not protected from a fall hazard of approximately fourteen (14) feet in that the scaffolding was approximately 20 inches from the face of the work and no fall protection was provided.  (b) On or about July 14, 2021, an employee working on the second tier of self-supported tubular welded end frame scaffolding at the corner was not protected from a fall hazard of approximately fourteen (14) feet in that the scaffolding was approximately 20 inches from the face of the work and no fall protection was provided.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access:  (a) On or about July 14, 2021, at least one employee was accessing self-supported welded tubular end frame scaffolding by using the end frames and cross braces exposing him to a fall hazard of up to approximately fourteen (14) feet to the ground below.  JORGE MORENO WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD (1926.451(e)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1262565, CITATION NUMBER 01, ITEM NUMBER 002, AND WAS AFFIRMED AS A FINAL ORDER ON 01/09/2018, WITH RESPECT TO A WORKPLACE LOCATED AT 4005 GASTON AVE, DALLAS, TX 75246.
