29 CFR 1910.147(c)(6)(i):The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed. a) On or about 07/05/2021, periodic inspections of the energy control procedures to ensure that maintenance and sanitation were performing lock-out for equipment such as but not limit to the Oakes Machine were not conducted on third shift during sanitation cleaning and maintenance performance.

29 CFR 1910.147(c)(7)(i):The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: (A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the method and means necessary for energy isolation and control. a) On or about 07/07/2021, sanitation and maintenance employees were not adequately trained as authorized employees to recognized the need to lock out the energy isolation locations for the Oakes Machine during sanitation cleaning and maintenance tech performance.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (d)(1) preparation for shutdown. (d)(2) turn off and shut down of the machine (d)(3) physically locate and operate the energy isolating devices in such a manner as to isolate the machine or equipment from the energy sources. (d)(4) affix lockout or tagout devices to each energy isolating device (d)(6) Prior to starting work on machines that have been locked out or tagged out, verify that isolation and deenergizing of the machine or equipment have been accomplished. a) On or about 07/07/2021, during sanitation cleaning and maintenance performance employees were not locking out the energy isolations sources for the Oakes Machine by utilizing the specific procedures that requires (d)(1) through (d)(6) to be followed to accomplish lockout.

29 CFR 1910.37(a)(3): Maintenance, safeguards, and operational features for exit routes. Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level. a) On or about 07/14/2021, employees working inside the Raque Room were exposed to trip hazards, falls and being trap during but not limited to the need to evacuation; since route to the exit was block with a rack, pallet, etc. in front of the door.
