29 CFR  1910.147(c)(6)(i): The employer shall conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirements of this standard are being followed.  a.) On or about October 21, 2025, the employer did not ensure annual periodic inspections of the lockout/tagout energy control procedures for equipment such as, but not limited to, the Raque cream fillers were being conducted.

29 CFR  1910.147(c)(7)(i):The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following:  (A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a.) On or about October 21, 2025, the employer did not ensure that employees making adjustments on the Raque line whipped topping dispensers were authorized to perform lockout/tagout, in that the employees had not been trained in the methods and means necessary for the safe isolation and control of the electrical and pneumatic energy sources.

29 CFR  1910.147(f)(1): Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the following sequence of actions shall be followed:  (ii):Remove employees from the machine or equipment area in accordance with paragraph (e)(2) of this section;  a) On or about October 21, 2025, the employer did not ensure that employees were removed from the hazard of moving parts during testing and positioning of the Raque line cream dispenser in that an employee's fingertip was amputated after the dispenser activated while the guard was removed.
