OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from forklift loads creating struck-by/caught-between hazards:  a.)  Kinder Morgan Company, Inc.;  garage storage area - On or about 7/10/21, and at times prior thereto, personnel were not kept clear of compressor cylinders being moved by a Rough Terrain Forklift.  Additionally, the load (compressor cylinders) were not was not secured while being handled by the forklift .  An accident occurred when the  compressor cylinder slid off of the forks of a Rough Terrain Forklift and snagged/struck an employee who was performing spotting duties.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.
